1. Delivery and return. The vehicle is delivered
to the Renter in good overall condition, without
apparent defects, and any complaints as to its
condition must be made to the Lessor immediately
on delivery. The Renter agrees to return it with
car documents, accessories and equipment in good
condition to the Lessor at the location on the
date and time designated in this agreement. Over
3 hours delay from agreed return time specified
in rental agreement (if Renter don't notifies
the Lessor by telephone) the Lessor reserves the
right to notify immediately the Police for car
theft.
2. Condition of Use. The renter is agreed that
the vehicle shall not be operated or driven:
a)in contravention of any Customs, traffic or
other regulations;
b)to transport passengers or property for a
remuneration;
c)to propel or tow any vehicle, trailer or other
object;
d)while customer or any other driver of vehicle
is under the influence of alcohol, drugs,
narcotics, barbiturates or any other substance
impairing his consciousness or ability to react;
e)in the case of breakdown the repair of car
must be made by qualified person;
f)in any race, test or contest;
g)other than in accordance with the instructions
and recommendations by the manufacturer of the
vehicle.
3. Charges. The Renter is personally liable to
pay Lessor on demand :
a)time charges at the rate specified in
agreement;
b)a mileage charge computed at the rate
specified in agreement - for standard tariff; in
this situation Renter must pay 50 Euro per day
for deposit;
c)cars are delivered and/or collected with full
tank. Any balance according to level indicator
on board will be charged at gas station price;
d)minimum rental period is 1 day (24 hours).
First hour over 24 hours is free of charge. Next
3 hours are charged at 15 Euro. Over 3 hours
delay one full rental day is charged.
e)All fines and court costs for parking, traffic
or other legal violations assessed against the
vehicle;
f)In the event of loss or spoiling of car
documents or car keys will be charged at 50
Euro.
4. Insurance. The car is insured for third party
liability.
The Renter and his companions should hold own
personal accident insurance (PAI).
The Renter is responsible and must pay all
damage if driver is under the influence of
alcohol or drugs, in case of accident.
a)COLLISION DAMAGE REDUCTION (CDR)
Renter's liability for any damage may be reduce
to 300 Euro for an additional daily charge
(CDR), quoted in price list.
Without CDR renter is liable for damages on
rented car up to 20,000 Euro.
b)THEFT PROTECTION (TP)
Renter's liability in case of theft may be
reduce to 300 Euro for an additional daily
charge (TP), quoted in price list.
Without TP renter is liable for theft of rented
car up to 20,000 Euro.
c)COMBINED FULL COVERAGE (CFC) for CDR and TP
Accepting the CFC for CDR and TP eliminates the
renter's liability entirely.
Without presentation the Police Documents
(showed below) to the lessor or if the driver /
renter is in breach of the Romanian Law(s) or of
the Romanian Traffic Code or of any part of the
Rental Agreement, the renter remains fully
liable for all damages, costs and/or losses
(including but not limited the loss of income)
irrespective of fault.
5.Indemnity. The Lessor can not be held
responsible for any damages suffered by the
Renter or his companions in connection with the
operation of the vehicle, for loss or damage to
renter's property left in the vehicle or from
other causes.
6.Accident, Damage, Theft.
Renter agrees further to protect the interests
of Lessor and its insurance company in case of
accident, theft or damage to the vehicle by:
a)obtaining names and address of parties
involved and of witnesses;
b)not abandoning the vehicle without adequate
provision for safeguarding and securing same;
c)notifying the Lessor by the telephone even in
case of slight damage;
DOCUMENTS TO BE OBTAINED IN CASE OF ACCIDENT,
DAMAGE OR THEFT.
Following documents must be obtained from the
nearest Police immediately after the accident or
theft of vehicle and must contain:
1.POLICE REPORT with: - the signature of the
Police officer issuing the report and the rubber
stamp of the Police station;
- specification of driving/not driving under the
influence of alcohol (in case of accident)
or THE 2nd ANNEX (for insurance company) - the
signature of the Police officer issuing the
document and the rubber stamp of the Police
station
2.REPAIR AUTHORIZATION with: - the signature of
the Police officer issuing the document and the
rubber stamp of the Police station
7.Validity. The renter is agreed that any
addition or alteration to these terms and
conditions shall be null and void unless agreed
upon in writing by the parties.
8.Jurisdiction. All disputes arising from car
rental within these Terms and Conditions shall
be adjudged by the court of Bucharest, Romania.
Rates/Terms/Conditions are subject to change
without notice.
